§ 73.35 DEFINITION; PERMIT REQUIRED.
   (A)   Any person desiring to operate a golf cart, as defined in Neb. RS 60-6,380, upon the public streets of the village, other than in parades, which has been authorized by the chair and Board of Trustees of the village as herein indicated shall first apply for a permit upon application forms furnished by the Village Clerk/Treasurer, and receive from the Clerk/Treasurer a permit for said operation of said golf cart (low-speed vehicle).
   (B)   The requirements and criteria for obtaining said permit shall be as follows:
      (1)   Sixty inches or less in width;
      (2)   Gross vehicle weight rating of 3,000 pounds or less;
      (3)   Travels on three or four low-pressure tires;
      (4)   Maximum speed attainable is not more than 25 mph on a paved or level surface;
      (5)   Has a seat for the operator and a seat for a passenger if so desired by the original manufacturer;
      (6)   Has handle bars or other steering assembly for steering control;
      (7)   Is equipped with a bicycle safety flag attached to the rear of such vehicle, extending not less than five feet above the ground; the bicycle safety flag shall be triangular in shape with an area of not less than 30 square inches and shall be day-glo in color;
      (8)   Is equipped with a slow moving vehicle emblem on the rear of the vehicle;
      (9)   Has a brake system maintained in good operating condition;
      (10)   Has an adequate muffler system in good working condition; and
      (11)   Has affixed to the vehicle a village permit pursuant to village rules and regulations as identified in § 73.15 of this chapter.
