§ 73.16 DEFINITION.
   ALL-TERRAIN VEHICLE, pursuant to Neb. RS 60-6,355, shall mean any motorized off-highway vehicle which:
   (A)   Fifty inches or less in width;
   (B)   Has a dry weight of 1,200 pounds or less;
   (C)   Travels on three or more low pressure tires;
   (D)   Is designed for operator use only with no passengers or is specifically designed by the original manufacturer for the operator and one passenger;
   (E)   Has a seat or saddle designed to be straddled by the operator;
   (F)   Has handlebars or any other steering assembly for steering control;
   (G)   Is equipped with a bicycle safety flag that extends not less than five feet above the ground, attached to the rear of such vehicle; the bicycle safety flag shall be triangular in shape with an area of not less than 30 square inches and shall be day-glow in color;
   (H)   Is equipped with a slow moving vehicle emblem on the rear of the vehicle;
   (I)   Has a brake system maintained in good operating condition;
   (J)   Has an adequate muffler system in good working condition;
   (K)   Has an adequate headlight and taillight system in good working condition; and
   (L)   Has affixed to the vehicle a village permit pursuant to village rules and regulations as identified in § 73.15 of this chapter.
