Dump truck tailgate banging and loader banding, as defined in § 114.01, is hereby prohibited in the city, and constitutes a violation of this chapter. It is the express duty of the red dirt mine facility operator to prevent a dump truck delivering anything to the mine, or receiving rock or dirt from the mine, from engaging in dump truck tailgate banging at any time upon its property. Dump truck tailgate banging shall constitute a violation of this chapter. Further, it is the express duty of the red dirt mine facility operator to prevent a loader or backhoe, or other similar loading machine, from engaging in loader banging, as defined in § 114.01, at any time upon his or her property. Loader banging shall constitute a violation of this chapter.
