For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates, or requires, a different meaning.
COMMERCIAL PURPOSES. The sale of material from a red dirt mining facility as either a cash transaction, part of contractual agreement involving payment for materials provided, or for use in another process to create a product with value.
DUMP TRUCK TAILGATE BANGING. The avoidable, and loud, banging of a dump truck tailgate used to vibrate the bed of the truck in order to loosen material in the bed sough to be dumped. The relatively quiet bang that might be unavoidable when a dump truck load is dumped, and the truck moves away from the pile without applying the truck’s brakes, is not regulated by this chapter.
HOUSE. Any habitable structure, including a mobile or manufactured home, a dwelling, a residence, an apartment, a condominium, a hotel, or motel.
LOADER BANGING. The avoidable, and loud, banging of loader and backhoe scoops, and the scooping mechanisms of other similar machines, used to vibrate the scoop in order to loosen material sought to be dumped.
OPERATION OF RED DIRT MINING FACILITY. Any operation of any mechanical equipment on the premises of the red dirt mining facility, or any operation of dump trucks, or other large vehicles, on the premises of the red dirt mining site. The removal, loading, or processing of materials shall constitute operation of the red dirt mining facility.
RED DIRT MINING. Any open excavation used for obtaining red dirt, or other type of soil used for paving, grading, fill, or any construction, or commercial, purposes.
