§ 91.99  PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code.
   (B)   (1)   Any person or entity which makes a street cut in violation of §§ 91.15 through 91.20 of this chapter shall be fined a sum of not less than $10, nor more than $25, for each violation. Each day §§ 91.15 through 91.20 of this chapter is violated shall be deemed a separate violation.
      (2)   In addition, any person or entity in violation of §§ 91.15 through 91.20 of this chapter may be liable in damage to the city for three times the cost of restoration of the street cut.

   (C)   Failure of a property owner to pay an assessment within 30 days after notification pursuant to § 91.36(A) of this chapter shall be a misdemeanor punishable by a fine not to exceed $500, imprisonment not to exceed 30 days, or both. In addition, the city may initiate a civil action to collect from the property owner the cost of repairs made by the city under § 91.36(B) of this chapter.
