§ 32.02 SMOKING IN CITY OWNED BUILDINGS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CITY BUILDING. The City Hall building and Fire Station in its entirety.
      SMOKING. To smoke or carry any lighted cigar, cigarette or tobacco product in any form.
   (B)   Smoking prohibited in city buildings, with the exceptions listed in division (C) below. Nothing in this section shall be construed to in any way affect smoking regulations imposed by the Fire Chief or other laws, ordinances or regulations.
   (C)   Smoking allowed in certain areas of City Hall building. The following spaces shall be designated smoking areas:
      (1)   The area upstairs with the concrete floor immediately inside the exterior door located at the southwest corner of the building;
      (2)   The area in the downstairs lobby with concrete floors; and
      (3)   The floor of the gymnasium between the hours of 5:00 p.m. and 8:00 a.m.
   (D)   Smoking prohibited/enforced.
      (1)   Signs prohibiting or permitting smoking shall be posted conspicuously at every entrance and in prominent locations throughout the City Hall building and Fire Station. The signs shall be of a form and size approved by the City Council and contain a reference that regulation is by ordinance.
      (2)   It shall be unlawful for any person to remove, deface or destroy any sign required by division (D)(1) above.
