13.08.351 Mercado Outlet Mall trunk sewer fee.
   A.   All connections to the Mercado Outlet Mall trunk sewer, within the cross-hatched area on the Mercado Sewer Trunk Service Area Map (“Attachment A”) attached to the ordinance codified in this section and on file in the office of the city clerk, whether direct or indirect, will be subject to the Mercado Outlet Mall trunk sewer charge.
   B.   The Mercado Outlet Mall trunk sewer charge shall be paid at the time the building permit is issued. No connection is permitted until payment has been received by the city.
   C.   The funds collected will be placed in a restricted “major sewer line account” and can only be used to install future major trunk, interceptor, or relief services.
   D.   The charge will be based upon the following fee schedule:
   1.   The city has constructed a sewer line to provide sewerage service to the Mercado Factory Stores Outlet Mall. The line will also provide sewerage service on either side of the line and around the mall. This plan provides for reimbursement to the city for the costs incurred in building the line.
   2.   A total of three hundred thirty thousand one hundred thirty-three dollars and sixty-five cents was expended to construct the Mercado sewer line. The cost includes construction costs, engineering costs, inspection costs, and incidental costs.
   3.   The service area for the Mercado sewer line is as shown in the cross-hatched area on the map (“Attachment A”) referenced in subsection A of this section. The net area comprises 2,513.21 acres. Computation of the net area for each section consisted of deducting half section line rights-of-way of fifty feet and midsection line rights-of-way of eighty feet from the gross acreage. Any development within the service area that does not receive sewerage service from the Mercado sewer line shall not be charged this development fee and likewise any development outside the service area that receives sewerage service from the Mercado sewer line will be charged this development fee.
   4.   The base reimbursement rate shall be as follows:
   Total cost $330,133.65 = $131.36/acre
   Net acreage 2,513.21
   5.   Reimbursement due the city shall be adjusted to reflect the current prevailing market rate of construction. The index rate of adjustment shall increase according to the Engineering News Record index using August, 1991, as the base rate. The August, 1991, Index value was four thousand eight hundred ninety-two dollars and nine cents. The calculation is as follows:
