8.12.270 Habitual offender.
   A.   A person who commits a violation of this Chapter after previously having been found responsible for committing three or more civil violations of this Chapter within a twenty-four month period, whether by admission, by payment of the fine, by default, or by judgment after hearing, shall be guilty of a class one misdemeanor.
   B.   The Casa Grande City Attorney's Office shall file a criminal misdemeanor complaint in the Casa Grande City Court against habitual offenders who violate this Chapter.
   C.   For purposes of calculating the twenty-four month period under this section, the dates of the commission of the offenses are the determining factor.
   D.   Upon conviction of a non-enterprise person of a violation of this Chapter, the Court may impose a sentence of incarceration not to exceed six months in jail or a fine not to exceed two thousand five hundred dollars, exclusive of penalty assessments prescribed by law, or both. The Court shall order a person who has been convicted of this section to pay a fine of not less than $500.00 for each count upon which a conviction has been obtained.
   E.   Upon conviction of an enterprise of a violation of this Chapter, the Court may impose a fine not to exceed twenty thousand dollars, exclusive of surcharges or penalty assessments prescribed by law, or both. The Court shall order an enterprise who has been convicted of this section to pay a fine of not less than $1000.00 for each count upon which a conviction has been obtained.
   F.   Every action or proceeding under this Section shall be commenced and prosecuted in accordance with the laws of the State of Arizona relating to criminal misdemeanors and the Arizona Rules of Criminal Procedure.
