5.16.050 Fines; Penalties.
   A.   Any person, firm, company, or corporation violating any of the provisions of this chapter is guilty of a petty offense and, if no other punishment is provided, shall, upon conviction, be punished by a fine of not less than one hundred, nor more than three hundred, dollars for each violation. Each day a violation continues shall constitute a separate offense.
   B.   Habitual Offender. An "habitual offender" is a person who commits a violation of any provision of this chapter, after having previously been found responsible for two or more violations within a twenty-four-month period, whether by admission, by payment of the fine, by default or judgment after hearing. For purposes of this section, the dates of calculating the 24-month period shall be the dates of commission of the offenses. Offenses committed by habitual offenders, as defined herein, shall be treated as a Class 2 misdemeanor, punishable by a sentence of incarceration not to exceed four months, a fine not to exceed $750 (exclusive of penalty assessments prescribed by law), or both.
