A. In-lieu fee structure for reduced parking minimums permitted. Parking space minimum requirements may be reduced if an in-lieu fee is approved by the City Traffic Engineer and the Director. An in-lieu fee must meet the following conditions:
1. In-lieu fee shall be established by City Council.
2. The in-lieu fee paid for each space shall be dedicated to the future provision of public parking in the Downtown General Plan land use category.
3. Agreement for in-lieu fee structure at a particular site must demonstrate that reduced parking will not cause adverse impacts on surrounding properties and parking areas, nor cause adverse impacts on the safety, health or general welfare of surrounding community.
4. All in-lieu fees must be paid in-full before issuance of the building permit for principal use.
