9.22.020   Fireworks prohibited; exceptions.
   A.   The use, discharge or ignition of fireworks within the City is prohibited, except as provided for in this section:
   1.   The use, discharge or ignition of permissible consumer fireworks within the City is permitted as follows:
   a.   Between the hours of 8:00 A.M. to 11:00 P.M. on the following dates:
   i.    June 24th through July 6th.
   ii.   December 26th through January 4th
   b.   The use of permissible fireworks is also allowed during the following times:
   i.   Between the hours of 11:00 P.M. on December 31st through 1:00 A.M. on January 1st; and
   ii.   Between the hours of 11:00 P.M. on July 4th through 1:00 A.M. on July 5th.
   2.   The use, discharge or ignition of fireworks is prohibited on all public property including in all public parks and public right of way.
   3.   The use, discharge or ignition of fireworks is prohibited on the days specified herein if a federal or state agency implements a stage one or higher fire restriction. Any prohibition during those dates is limited to only the dates when the stage one or higher fire restriction is in place.
   B.   Nothing in this section or article shall be construed to prohibit the use, discharge or ignition of novelty items or the occurrence of a supervised public display of fireworks or prohibit uses as permitted pursuant to A.R.S. Section 36-1605(A).
   C.   Permits may be granted by the Fire Chief for conducting a properly supervised public display of fireworks provided the following are met:
   1.   Application for a permit shall be made in writing not less than five days prior to the date of the display.
   2.   Every display shall be handled by a competent operator, and shall be of a character and located, discharged, and fired so that it will not be hazardous to property or endanger any person.
   3.   Before a permit is granted, the operator, location and handling of the display shall be approved, after investigation, by the Fire Chief.
   4.   After a permit is granted, the sale, possession, use and distribution of fireworks for the display shall be lawful for that purpose only.
   5.   No permit is transferable or assignable.
   6.   A permit shall not be issued, and may be revoked, during time periods of High Fire Danger warnings as determined by the Fire Chief.
   7.   The Fire Chief has authority to impose conditions on any permits granted. (Ord. 1397.09.07 § 2, 2023: Ord. 1397.09.06 § 2 (part), 2010)
