A. Correction or Withdrawal Before Opening. Bids or proposals that contain errors or mistakes discovered by the bidder may be modified or withdrawn prior to the date and time set for opening of bids, provided the bidder establishes all of the following to the reasonable satisfaction of the purchasing officer:
1. A mistake was made in the preparation of the bid;
2. The bidder gave written notice of the mistake, and the manner in which it occurred, to the purchasing officer prior to bid opening;
3. The mistake caused the price to be materially different than the bidder intended it to be;
4. The mistake was made in filling out the bid, and not due to error in judgment or to carelessness in inspecting the site of the work, or in reading the bid documents.
B. Correction After Opening. A bidder may not change its bid or proposal after the date and time set for receipt of bids.
C. Withdrawal After Opening.
1. If deemed to be in the best interest of the city, the purchasing officer may allow the apparent prevailing bidder to withdraw its bid and award a contract to the next lowest, most responsive, bidder.
2. In the event that bid security was required and provided by the apparent prevailing bidder, the amount of the that bidder's bid security shall be applied to the difference between that bid and the next lowest bid, and the surplus, if any, shall be returned to the apparent prevailing bidder or that bidder's surety, as applicable.
