(A) A person shall have a soil erosion and sediment control plan approved by the Carroll County Soil Conservation District (“District”) and shall obtain a grading permit from the county prior to clearing, grading, grubbing, excavating, or filling land, creating borrow pits, or conducting mineral resource recovery operations, or otherwise modifying the existing topography of the land unless exempted by the provisions of § 152.003.
(B) A person shall obtain an approved erosion and sediment control plan for forest harvest operations, as outlined in § 152.022(C), from the District and a grading permit from the county prior to commencing any forest harvest operation or timber removal.
(C) A person shall not perform any activity not covered by divisions (A) and (B) above that results in land disturbance or the stockpiling of soil or other land disturbance materials without implementing measures to control erosion and the potential for sediment transport that could impact adjacent property owners, any watercourse or stream systems. Any land disturbing activities shall be controlled and then stabilized properly after completion. The site shall then be maintained to ensure that the site remains stable. This section does not apply to agricultural land management practices.
(D) Nothing set forth in this chapter shall be construed to be in conflict with Md. Code, Environment Article, Title 4, Subtitle 1, as it may be amended from time to time, and regulations adopted thereunder.
