§ 94.113 PERMITS.
   (A)   Requirement. In addition to any permit required elsewhere in this chapter, a permit shall be obtained from the appropriate Manager in advance for activities that the Manager deems a permit is necessary and for any activity requiring exclusive use of any park facility.
   (B)   Application. A person seeking issuance of a permit hereunder shall file an application with the appropriate Manager. The application shall state:
      (1)   The name and address of the applicant;
      (2)   The name and address of the person, persons, corporation, or association sponsoring the activity, if any;
      (3)   The day and hours for which the permit is desired;
      (4)   The park and portion thereof for which the permit is desired;
      (5)   The anticipated attendance; and
      (6)   Any other information which the Manager finds reasonably necessary to a fair determination of whether a permit should be issued.
   (C)   Standards for issuance. The Manager shall issue a permit hereunder when he or she finds that:
      (1)   The proposed activity or use of the park will not unreasonably interfere with or detract from the general public enjoyment of the park;
      (2)   The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation;
      (3)   The proposed activity or use is not reasonably anticipated to incite violence, crime, or disorderly conduct;
      (4)   The proposed activity will not result in unusual, extraordinary, or burdensome expense or police operation by the county; and
      (5)   The facilities desired have not been reserved for other use at the day and hour requested in the application.
   (D)   Appeal.
      (1)   Within ten days after receipt of an application, the Manager shall apprise an applicant in writing of the reasons for refusing a permit, and the applicant shall have the right to appeal in writing within ten days to the Director of the Department of Recreation and Parks, or its successor agency. The Director shall consider the application under the standards set forth in division (C) above and shall sustain or overrule the Manager's decision within ten days.
      (2)   The applicant shall have the right to appeal the Director's decision within ten days to the County Commissioners, which shall consider the application under the standards set forth in division (C) above and sustain or overrule the Director's decision within ten days. The decision of the County Commissioners shall be final.
