1-5-1: MAYOR:
   A.   Chief Executive Officer; Term Of Office: The chief executive officer of the city shall be a mayor, who shall be a qualified elector, reside within the city limits at least one year next preceding the election, and shall hold his office for four (4) years, and until his successor is elected and qualified.
   B.   Vacancy In Office: Whenever a vacancy shall occur in the office of the mayor, when the unexpired term shall be one year or over from the day the vacancy occurs, it shall be filled by an election.
   C.   Oath And Bond: Before entering upon the duties of his office, the mayor shall take the oath provided by law, and also execute a bond to the city with two (2) or more good and sufficient securities in the penal sum of five thousand dollars ($5,000.00), to be approved by the city council, conditional according to law.
   D.   Powers And Duties:
      1.   Presiding Officer; Voting Restrictions: The mayor shall preside at all meetings of the city council, but shall not vote except in case of a tie, when he shall give the casting vote:
         a.   Where one-half (1/2) of the aldermen elected have voted in favor of an ordinance, resolution, or motion even though there is no tie vote; or
         b.   Where a vote greater than a majority of the corporate authorities is required by statute or an ordinance to adopt an ordinance, resolution, or motion. (Ord. 8, 10-24-1899; amd. 2006 Code)
      2.   Legislation: The mayor shall sign all ordinances, resolutions, orders, or other legislative or judicial acts of the city council meeting his approval, and return to the city council, with his objections thereto, all ordinances that do not meet his approval, and when approved by him, his signature shall authenticate same.
      3.   Signature Required: In all contracts made between the city and any other party, the mayor shall sign the same in behalf of the city, and it shall be his special duty to see that the other contracting party complies with his part of the contract; and in appeals taken by the city in any legal matter, it shall be his duty to sign all papers and documents to which his signature may be necessary in the prosecution of such an offense.
      4.   Appointments: The mayor shall have power to appoint all officers (whose election by the voters is not provided for by law), by and with the consent of the city council, by a vote of the majority of all its members authorized by law to be elected, such vote to be taken by yeas and nays, to be entered on the record.       5.   Removals From Office; Appointments To Fill Vacancies:
         a.   The mayor shall have the power to remove any officer appointed by him, whenever, in his opinion, the interests of the city require such removal. He shall report such removal, with his reasons therefor, to the council at a meeting to be held not less than five (5) nor more than ten (10) days after the removal, and if the council, by a two-thirds (2/3) vote of all its members authorized by law to be elected, by yeas and nays, to be entered on the records, shall disapprove of such removal, such officer shall be restored to such office from which he was so removed, but he shall give new bond and take a new oath of office.          b.   The mayor may appoint any suitable person to discharge the duties of the office from which he shall have removed any officer until his successor is appointed and qualified, or such officer restored to office in the manner provided in subsection D5a of this section.
      6.   Police Powers: The mayor shall exercise, within the city limits, the powers conferred upon sheriffs to suppress disorder and keep the peace.
      7.   Pardons: The mayor may release any person from a violation of any city ordinance, and shall report such release, with the cause thereof, to the city council at its next regular meeting thereafter. (Ord. 8, 10-24-1899)
      8.   Civil Disorders: The mayor shall have power, when necessary, to call on every person in the city to aid in enforcing the laws and ordinances, and to call out the militia to aid in suppression of riots and other disorderly conduct or carry into effect any law or ordinance subject to the authority of the governor as commander in chief of the militia.       9.   Inspection Of Books And Records: The mayor shall have power at all times to examine and inspect the books, papers and records of any agent, employee or officer of the city.
      10.   Annual Report: The mayor shall annually, and from time to time, give the council information relative to the affairs of the city, and shall recommend for their consideration, such measures as he may deem expedient.
      11.   Additional Duties: The mayor shall perform all such duties as shall or may be prescribed by law, or by the ordinances, and shall take care that the laws and ordinances are faithfully executed.
   E.   Mayor Pro Tem 1 : During the absence or disability of the mayor, the city council shall elect one of its members to act as mayor pro tem who, during such absence or disability, shall possess the powers and perform the duties of mayor. (Ord. 8, 10-24-1899)
