1-5-2: RULES OF PROCEDURE:
Rules for the government of the city council are as follows:
   Rule I. Meetings: Until changed by proper action of the city council as provided by law, the regular meetings of the mayor and city council shall be held on the first and third Mondays of each month at seven o'clock (7:00) P.M. in the council room, municipal building, Carmi, Illinois. The same rule shall apply to special meetings. All meetings of the city council shall be open to the public unless otherwise excepted by law. (Ord., 11-10-1899; amd. Ord. 869, 5-7-1973; 2006 Code)
   Rule II. Punctuality: It shall be the duty of each alderman to be present and on time at every meeting of the city council (unless unavoidably prevented). No member shall absent himself during the session unless he is excused by a majority of the members present.
   Rule III. Presiding Officer: The mayor (or the presiding officer in his absence) shall enforce good order and decorum during the session of the council, and it shall be the duty of all present to respect his orders.
   Rule IV. President Pro Tem: In the absence of the mayor, the council may elect one of its members as its president pro tempore 1 .
   Rule V. Order Of Business: When the council shall be duly organized, the order of business shall be as follows:
      1.   Reading the minutes of the last regular meeting and intervening meetings.
      2.   Reception of petitions, memorials and resolutions.
      3.   Reports of standing committees.
      4.   Reports of special committees.
      5.   Reports of officers.
      6.   Miscellaneous business.
   Rule VI. Attendance At Meetings; Records Kept; Clerk Pro Tem: It shall be the duty of the city clerk to attend all meetings of the council (unless unavoidably prevented). He shall keep a correct record of the proceedings of each meeting, and shall perform such other duties as may be prescribed for him by ordinance. Should the city clerk be absent, the council may appoint a clerk pro tempore. (Ord., 11-10-1899)
   Rule VII. Special Meetings: The mayor or any three (3) aldermen may call a special meeting of the city council, but when any special meeting is so called, it shall be the duty of the mayor or aldermen aforesaid to notify in writing the members of the council to attend thereto, and it shall be the duty of the city clerk to serve such notice on each member. Such notice shall state the purpose for which such special meeting is called, and no other business shall be transacted except that specified in the call, unless a vote of a majority of the council present shall suspend this portion of the rule.    Rule VIII. Parliamentary Rules: The city council shall be governed by "Robert's Rules Of Order".
   Rule IX. Standing Committees: The mayor shall, at the first regular meeting in May of each election year, appoint the following standing committees, each to consist of two (2) members for all committees, except the library committee which shall consist of one member, who shall hold their places for two (2) years unless otherwise ordered by the council:
      1.   Committee on airport and buildings.
      2.   Committee on finance and budget.
      3.   Committee on streets and alleys.
      4.   Committee on fire department.
      5.   Committee on swimming pool, cemeteries and parks.
      6.   Committee on waterworks and sewer.
      7.   Committee on light and water administration.
      8.   Committee on light plant and line maintenance.
      9.   Library committee.
      10.   Committee on police, civil defense and animal control.
   Rule X. Passage Of Legislation:
      1.   All resolutions and motions: a) that create any liability against the city; b) that provide for the expenditure or appropriation of its money; or c) to sell any city or school property, and all ordinances passed by the city council shall be deposited with the city clerk. Except as provided in 65 Illinois Compiled Statutes 5/4-1-1 et seq., and 5/5-1-1 et seq., if the mayor approves an ordinance or resolution, the mayor shall sign it. Those ordinances, resolutions, and motions which the mayor disapproves shall be returned to the city council, with the mayor's written objections, at the next regular meeting of the city council occurring not less than five (5) days after their passage. The mayor may disapprove of any one or more sums appropriated in any ordinance, resolution, or motion making an appropriation, and if so, the remainder shall be effective. However, the mayor may disapprove entirely of an ordinance, resolution, or motion making an appropriation. If the mayor fails to return any ordinance or any specified resolution or motion with his written objections within the designated time, it shall become effective despite the absence of the mayor's signature.
      2.   Every resolution and motion specified in paragraph 1 of this rule, and every ordinance that is returned to the city council by the mayor shall be reconsidered by the city council at the next regular meeting following the regular meeting at which the city council receives the mayor's written objection. If, after reconsideration, two-thirds (2/3) of all the aldermen then holding office on the city council agree at that regular meeting to pass an ordinance, resolution, or motion, notwithstanding the mayor's refusal to approve it, then it shall be effective. The vote on the question of passage over the mayor's veto shall be by yeas and nays and shall be recorded in the journal.
   Rule XI. Committee Reports; Final Action: Any report of a committee of the council shall be deferred for final action thereon to the next regular meeting of the same after the report is made, upon request of any two (2) aldermen present.
   Rule XII. Voting: All votes of the city council shall be viva voce, except upon the passage of ordinances and on propositions to create any liability against the city, or for the expenditure, on appropriation, of its money, or upon the request of any member when the yeas and nays shall be taken and entered upon the journal, and the concurrence of a majority of all the members elected in the council shall be necessary for the passage of any such ordinances or propositions. Provided, a two-thirds (2/3) vote of all the aldermen elect shall be required to sell any city property.
   Rule XIII. Written Legislation: All petitions, memorials, resolutions, reports and amendments shall be presented in writing before any action is taken thereon.
   Rule XIV. Mayor's Veto: Upon the return of any ordinance by the mayor, the vote by which the same was passed shall be reconsidered by the council, and if, after such reconsideration, two-thirds (2/3) of all the members elected to the city council shall agree, by yeas and nays, to pass the same, it shall go into effect, notwithstanding the mayor may refuse to approve thereof. The vote to pass the same over the mayor's veto shall be taken by yeas and nays and entered on the journal.
   Rule XV. Suspension Of Rules: Any of the above rules may, by a vote of a majority of the members present at any meeting, be suspended.
   Rule XVI. Amendments; Adoption Of New Rules: Any of the above rules may be altered, amended or rescinded, or any new rules adopted, at any meeting of the council by a vote of a majority of the members present. (Ord., 11-10-1899; amd. 2006 Code)
