(A) (1) General criminal penalties.
(a) Any person who violates any provision of this chapter, permit or permit contract, or who violates any administrative order, prohibition or effluent limitation, is guilty of a misdemeanor, and, upon conviction, is punishable by a fine not to exceed $1,000 or imprisonment for not more than 30 days in the county jail, or both.
(b) Each day a violation occurs may constitute a new and separate offense and may subject the violator to an additional full measure of penalties as set forth herein.
(2) Falsifying information. Any person who knowingly makes any false statements, representations or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter, or wastewater discharge permit, wastewater discharge permit contract or who falsifies, tampers with or knowingly renders inaccurate any monitoring device or method required under this chapter, shall upon conviction be punished by a fine of not more than $1,000 or imprisonment for not more than 30 days, or both. Each separate act of falsification, tampering or knowingly rendering inaccurate any device or method, shall constitute a new and separate offense and shall be subject to the penalties contained herein.
(B) Nothing in this section is intended to exclude the potential for prosecution under the applicable perjury statutes of the state to the extent such falsification was incorporated in a document signed under the penalty of perjury.
