1040.10 SEWER RATES.
   (a)   Determined by Water Usage. Sewer rates determined by water usage will be 150 percent of the charge made by US Filter/EOS to the Municipality for flow through the system.
   (b)   Flat Rate Without Water Usage. For each single family residence (one equivalent residential unit (ERU)) served by the sanitary sewer system to which a Municipal water supply is not available or is not being utilized, there shall be a flat monthly charge as provided in the General Fee Schedule.

   (c)   Maximum Charge. The sewer service charge shall be based upon the metered rate of water usage or the minimum bimonthly rate, whichever is greater. However, to allow for water consumption which is not ultimately discharged into the sanitary sewerage system, a maximum sewer service charge shall be established for single family residential consumers only on an individual basis for the summer months. The maximum charge shall be 125 percent of the average winter consumption for the four billing periods November through June. Each consumer's maximum charge may differ and shall be adjusted annually. For new services established during or after the winter base period for which only one or two meter readings have been obtained, an average maximum charge for the area will be calculated and applied for the initial summer period.
   (d)   Excessive Pollutants. Any waste containing BOD, suspended solids or any other pollutants that are in excess of normal domestic sewage (i.e. 200 mg/l BOD or 250 mg/l SS) that is discharged into the sewerage system shall be subject to a surcharge as determined by the Sanitary Engineer.
    (e)   Right to Increase Charges. The charges provided for in this section are minimum, not maximum, charges and the Municipality serves the right and is obligated to increase the same at any time if the revenues of the sewerage system are insufficient to pay the operation and maintenance expenses and the debt service and reserve charges of revenue bonds issued to construct or to improve the sewerage system.
   (f)   Revenue Bonds. The rate structure provided for in this section is an integral part of the financing of the sewerage system construction and improvements inasmuch as the establishment thereof is necessary to provide sufficient coverage for principal and interest charges on issues of revenue bonds and for other requirements created by resolutions authorizing such issues of bonds. The maintenance of the sewerage rate structure shall be for the benefit of the purchasers and holders of such issues of bonds and shall constitute a contract with them by the terms of the rate resolutions and these Water and Sewer Regulations.
