921.01 CONTROLLING AUTHORITY.
   (a)   The Village Administrator is the managing authority of both the water and sanitary sewer systems for the Village of Cardington. The Village Administrator may make such by-laws and/or rules as outlined under Ohio R.C. 735.29 to ensure the safe economical and efficient management of the water and sanitary sewer systems. These regulations, when not in conflict with Village ordinances or laws of the State, shall have the same validity as an ordinance.
   (b)   The Village Council has adopted the enclosed regulations governing the water and sewer systems. Violation of these regulations shall be punishable by a one hundred dollar ($100.00) per day fine or three days in jail. Each day that a violation exists shall constitute a separate offense.
   (c)   The Water-Wastewater Supervisor or duly authorized person(s) by the Village Administrator shall be responsible for the enforcement of these regulations and shall have the authority to serve notice to violators thereof; and shall have powers and authority necessary and proper for the enforcement of these regulations.
   (d)   The Water-Wastewater Supervisor or duly authorized person(s) by the Village Administrator shall be responsible for the enforcement of these requirements and shall have the authority to serve notice to violators thereof; and shall have powers and authority necessary and proper for the enforcement of these requirements.
   (e)   The Water-Wastewater Supervisor and other duly authorized employees of the Village Administrator, bearing proper credentials, shall be permitted to enter upon all properties that are served by the Village for the purpose of surveying, inspection, maintenance or repairs. Repairs requiring excavation shall be made under the terms of the easement.
   (f)   The Water-Wastewater Supervisor or other duly authorized employee of the Village Administrator may discontinue utility service(s) in the event of any of the following:
      (1)   A threat to the health, safety and welfare of the community.
      (2)   Non-payment of fees charged.
      (3)   Tampering or negligent care of a water meter.
      (4)   Failure to comply with the requirements outlined in Sections 921.07 through 921.10.
   Service shall not be resumed until all relevant matters subsections (f)(1) through (4) are resolved.
   (g)   When damage or impairment to the Village’s water or sewer systems has been caused by the negligence. The Village Administrator is authorized to charge the violator for all costs incurred in correcting said damage or impairment.
   (h)   The Village Administrator is authorized under the Ohio R.C. 735.29 to submit to the County Auditor for collection with property taxes all unpaid water/sewer charges and penalties. (Ord. 94-6. Passed 5-2-94.)
