557.04 DANGEROUS TREES ON PRIVATE PROPERTY, INSPECTIONS, AND REMOVAL ORDER.
   (a)   No owner, tenant or person in possession of or control over any lot or land shall permit or allow any tree to continue to exist which, because of age, disease, location, or for any other reason, has become dangerous to the residents of the Village; provided, however, the Village shall be responsible for maintaining trees in the street tree lawn (the area between the paved portion of a street and the sidewalk). If there is no street tree lawn, the owner, tenant or person in possession of or control over the property remains responsible. The Village Administrator is hereby authorized to make inspections in order to ascertain whether any dangerous tree contemplated by this section exists on any lot or land. For the purpose of making inspections under the provisions of this section, the Village Administrator, or his duty authorized representative, shall, at all reasonable hours, have the right to enter lawfully into and upon any lot or land located within the Village.
   (b)   No owner, tenant or other person in possession of or control over shall prevent, obstruct, or interfere with the Village Administrator, or his authorized representative, in making any lawful inspection under this section.
   (c)   If the Village Administrator, or his authorized representative, upon making any inspection allowed by this section, finds any tree located on any lot or land on private property which he determines to be dangerous under this section, he shall condemn such tree and order the owner and the tenant or person in possession of or control over such lot or land, in writing, to remove such tree within the time specified in the order which shall not be less than fifteen days. If, however, the Administrator finds that the condition of any such tree creates an emergency due to the risk of imminent serious physical harm to person(s) or property, the Administrator may require the property owner, tenant or other person in possession of or control over the lot or land to remove any such tree within such time as may be reasonable under the circumstances.
   (d)   Notice of such order shall be served as provided in Section 557.06(c). No person shall fail to comply with such order within the prescribed time.
