557.06 NOTICE TO CUT WEEDS, VINES OR GRASS; NOTICE TO TRIM TREES; NOTICE TO REMOVE TREE.
   (a)    If the Village Administrator, or his designee, becomes aware of an alleged violation of any provision of this chapter, the Village Administrator, or his designee, shall investigate the allegation. If the Village Administrator, or his designee, finds conditions which violate this chapter:
      (1)    The Village Administrator, or his designee, shall cause a Notice to Cut Weeds, Vines, or Grass (notice to cut), a Notice to Trim Trees (notice to trim) and/or a Notice to Remove Tree (notice to remove) (collectively "notices") to be posted on one or more places at the property on which the violation is occurring or the Notice of Violation will be mailed to the property owner.
      (2)    The notices shall be in a form approved from time to time by the Village Administrator.
      (3)    The notice to cut shall:
         A.    Describe the nature of the violation;
         B.    Require the person(s) to whom it is directed to correct or eliminate the violation by the end of the second business day following the date of notice or the end of the second business day after they have received the letter in the mail;
         C.    State the date and time the notice to cut was posted or mailed.
         D.    Warn that if the violation is not eliminated, the owner, tenant or other person having possession of or control over the lot or land may be cited for a criminal violation of this chapter, or may have the cost of the Village cutting the offensive or noxious weeds, vines or grass in excess of ten inches high assessed and made a lien against the property.
      (4)    The notice to trim shall:
         A.   Describe the nature of the violation;
         B.    Require the person(s) to whom it is directed to correct or eliminate the violation by the end of the second business day following the date of notice (or the end of the second business day after they have received the letter in the mail);
         C.    State the date and time the notice to trim was posted or mailed;
         D.    Warn that if the violation is not eliminated, the owner, tenant or other person having possession of or control over the lot or land may be cited for a criminal violation of this chapter, or may have the cost of the Village trimming the low hanging branches assessed and made a lien against the property.
      (5)    The notice to remove shall:
         A.    Describe the nature of the violation;
         B.    Require the person(s) to whom it is directed to correct or eliminate the violation within fifteen days following the date of notice (or the end of the second business day after they have received the letter in the mail);
         C.    State the date and time the notice to remove was posted or mailed;
         D.    Warn that if the violation is not eliminated, the owner of the property, tenant or other person having possession of or control over the lot or land may be cited for a criminal violation of this chapter, or may have the cost of the Village removing the dangerous tree assessed and made a lien against the property.
   (b)    Notwithstanding the foregoing, if the Village Administrator finds that one or more notices have been posted on the property within the previous twelve months, then the Village Administrator may determine to by-pass the notice procedure and immediately refer the new violation to the Village of Cardington Mayor's Court.
