5-5-22: REGULATIONS SPECIFIC TO THE OPERATION OF FOOD TRUCKS:
A food truck vendor is a person engaged in the business of selling food or nonalcoholic beverages from a self-contained motorized vehicle or a self-contained enclosed trailer with valid license plates and registration. A food truck vendor does not include an ice cream truck operator.
   A.   Display: Food truck/trailer permit holders are permitted to operate within the City of Carbondale if they have received a valid permit from the Jackson County Health Department (JCHD). Food truck vendors are required to present an approved JCHD permit to the City of Carbondale for issuance of a City permit. All permits must be displayed on each vehicle.
   B.   Vending Stations:
      1.   Private Property - Food truck/trailers and pushcart operators may operate from properly zoned private property in accordance with all applicable laws and ordinances and with the permission of the property owner.
      2.   Public Property Controlled by the City of Carbondale - Sales occurring on public property controlled by the City of Carbondale by Food truck/trailer and pushcart operators are permitted only from designated food truck vendor areas. Maps of these designated places of sales are available in the City Clerk’s Office and on the City’s website. The issuance of an annual license does not in any way reserve or designate space in the food truck vendor areas. Availability will be on a first come, first serve basis.
      3.   Public Property Controlled by Others – Sales occurring on public property controlled by Southern Illinois University, Carbondale Park District, or other units of government may occur with the permission of the respective entity or unit of government.
   C.   Vehicle Appearance And Maintenance: Vehicles utilized for food truck vending shall be kept in good mechanical and structural condition.
   D.   Disposal Of Fats, Oil, And Grease: No oil may be disposed of on public property or in the sewer system.
   E.   Liability Insurance Requirements: Any food truck/trailer or pushcart vendor operating on public property controlled by the City of Carbondale shall maintain evidence of liability insurance in the form of a certificate of insurance issued by an insurance company licensed to conduct license business in the State of Illinois. The certificate shall insure the vendor in the amount of no less than one million dollars ($1,000,000.00) single limit coverage, and shall also name the City as an additional insured.
   F.   Health And Safety Standards: Food truck vendors shall only permit sales from the curb side of the vehicle when parked on a City street.
   G.   All sales from Food Truck/Trailer and Pushcart licensees are required to collect and remit food and beverage tax as required by Title 7, Chapter 12 of the Carbondale Revised Code. (Ord. 2017-55; Ord. 2022-21)
