4-16-2: DEFINITIONS:
For the purpose of this chapter, certain words, phrases and terms shall have the following definitions and meanings:
BUILDING:
Any commercial or residential structure occupied or intended for supporting or sheltering any occupancy.
CITY:
The City of Carbondale, Jackson County, Illinois.
OWNER:
Any person, agent, operator, firm, or legal entity having a legal or equitable interest in the property; or recorded in the official records of the state, county, or City as holding title to the property; or otherwise having control of the property, including the guardian of the estate of any such person, the executor or administrator of the estate of such person if ordered to take possession of real property by a court; or any person maintaining, operating or previously having collected rent for any vacant building.
PERSON:
A person includes a corporation or other entity as well as an individual over the age of 21.
SECURED BUILDING:
A building which has had, in a manner intended to be temporary or permanent, all openings, including windows and doors which are present for the purpose of light, ventilation or egress, operable, secured, and locked at all times.
VACANT BUILDING:
A building or portion of a building which is the primary structure on a parcel or property that is:
1.   Unoccupied and unsecured; or
2.   Unoccupied and secured by boarding or other similar means; or
3.   Unoccupied and a dangerous structure; or
4.   Unoccupied and condemned pursuant to applicable law; or
5.   Unoccupied and has code violation(s); or
6.   Unoccupied and the building or its premises has been the site of unlawful activity within the previous six (6) months; or
7.   Unoccupied for over ninety (90) days.
A vacant building shall not include unoccupied buildings, which are undergoing construction, renovation, or rehabilitation and which are otherwise in compliance with all applicable City ordinances, codes, and regulations, and for which construction, renovation or rehabilitation is proceeding diligently to completion. A vacant building shall not include residential property listed for sale with a licensed real estate agent that has been occupied within the previous one hundred and twenty days (120) by the owner of record, and which are in compliance with all applicable City ordinances, codes, and regulations.
