A. Permit Required: A person desiring to move or relocate a building or structure from within the corporate limits of the city to a new location within said corporate limits to a location outside said corporate limits or from outside said corporate limits to a location within said corporate limits must first obtain a moving permit.
B. Application Requirements: Before a moving permit will be considered by the city manager, the applicant for the permit shall provide, in writing, to the building and neighborhood services manager the following:
1. Statement Of Purpose: A statement of purpose for the move which shall include:
a. The type of structure being moved including the size (1 story, etc.), approximate square footage, construction material (wood, brick, etc.), and the type of foundation on which the structure will be placed.
b. The intended use of the structure at the new location.
c. The owner(s), including beneficial interest holder(s) of both the structures and the property where the structure will be located.
2. Certificate Of Insurance: A certificate of insurance in the minimum amounts of:
General liability: One million dollars ($1,000,000.00);
Automobile liability: Five hundred thousand dollars ($500,000.00); and
Excess liability: One million dollars ($1,000,000.00)
in the name of the "city of Carbondale" as certificate holder or additional insured. The certificate of insurance shall be approved by the city attorney.
3. Route Plan: A written route plan which has been approved in writing by the public works director, the Carbondale police department, the supervisors of all utilities operating in the city, and the supervisors of any other utilities which are operating within the route plan. The route plan will indicate the route to be taken and the date and time of the relocation.
4. Zoning Certificate: A zoning certificate issued for the site of the relocation. This requirement will be deemed unnecessary if the relocation is outside the zoning jurisdiction of the City.
5. Building Permit: A building permit issued for the site of the relocation for footings, foundation construction and other renovation necessary to bring the structure into compliance with the Building Code of the City. This requirement will be deemed unnecessary if the relocation is outside the corporate limits of the City.
6. Electrical Permit: An electrical permit issued to a licensed electrician. This requirement will be deemed unnecessary if the relocation is outside the corporate limits of the City.
7. Plumbing Permit: A plumbing permit issued to a plumber licensed by the State. This requirement will be deemed unnecessary if the relocation is outside the corporate limits of the City.
C. Evaluation Of Application; Decision: Once the applicant provides the Building and Neighborhood Services Manager with notice and documentation of all the application requirements listed in subsection B of this Section, the Building and Neighborhood Services Manager will provide the documentation to the City Manager. The City Manager shall evaluate the application based upon compliance with the application requirements, the type of structure to be moved, the intended use of the structure at the new location and the impact of the structure on the neighborhood where the structure will be located. The City Manager will give a written notice of his decision to the applicant. The decision will be mailed to the applicant at the address listed on the application.
D. Notice Of Denial; Appeal: An applicant who is denied a moving permit may appeal the decision of the City Manager to the City Council. To initiate such an appeal, the applicant must notify the City Manager, in writing, within five (5) days of receiving notice of the denial. The appeal will be placed on the agenda of the City Council. The applicant will be allowed to address the Council and present relevant evidence regarding the application. Other evidence may be presented as necessary to ensure a just and informed decision by the City Council. The decision of the City Council shall be final.
E. Fee: The fee for a permit to move a building or structure into, out of, or within the corporate limits of the City shall be one hundred dollars ($100.00) per building or structure. (1998 Code)
F. Violation; Penalty: Any person who shall move or relocate, or cause to be moved or relocated, a building or structure without having first obtained a permit therefor, or who shall fail or refuse to pay the fee therefor as herein provided shall, upon conviction, be subject to a fine of not less than two hundred dollars ($200.00), nor more than seven hundred fifty dollars ($750.00).
