4-1-1: ADOPTION OF BUILDING CODE:
   A.   Adopted By Reference: The International Code Council ("ICC") international building code, 2003 edition (hereinafter referred to as "building code for multi-family and commercial applications"), is hereby adopted by reference, except for such portions as are specifically hereinafter deleted, modified or amended.
   B.   Multi-Family And Commercial Application:   ICC international building code, 2003 edition, is adopted for the purpose of establishing rules and regulations for the construction, alteration, removal, demolition, equipment, use, occupancy, locations and maintenance of all buildings except one- and two- family dwelling units within the jurisdiction of the city.
   C.   Copy On File: A copy of the ICC international building code, 2003 edition, including all amendments made by this section shall be kept on file in the office of the city clerk, and the same is hereby adopted and incorporated by this chapter as fully as if set out at length herein. The provisions hereof, including all amendments, shall be controlling the construction of all buildings and structures except one- and two-family dwelling units within the jurisdiction of the city.
   D.   Exceptions And Modifications To Code: The ICC international building code is adopted as set forth hereinabove with the following exceptions and modifications:
      1.   Any section which refers to "name of jurisdiction" is hereby modified by inserting "the city of Carbondale, Illinois."
      2.   All provisions contained in the ICC international building code, 2003 edition, referring to the following terms or phrases are hereby deleted and this city code shall govern these items:
      Accessibility
      Board of appeals
      Bond and liability insurance
      Buildings with one exit
      Department of building safety
      Energy conservation
      Exemptions
      Fee schedule
      ICC electrical code
      Identification
      Means of appeal
      Physically handicapped and aged
      Plumbing systems
      Ramps
      Rear yard
      Rehabilitation
      Unlawful continuance
      Violation penalties (Ord. 2003-72)
   E.   Fire Districts Designated: Fire districts are designated and construction types therein are limited as follows:
      1.   The primary fire district is hereby designated, as all property zoned or hereafter zoned, primary business in accordance with title 15 of this code.
      2.   The secondary fire district is hereby designated, as all property or hereafter zoned, professional administrative office, secondary business, planned business, wholesale and automotive, neighborhood business, and light industrial in accordance with title 15 of this code.
Any of the five (5) construction types defined in section 602.0 of the 2003 edition of the ICC shall be permitted in the primary and secondary fire districts, except that type 5B construction shall be restricted to residential construction within the secondary fire district. Any proposed building structure that will be located five (5) or fewer feet from an existing building structure shall be required to be designed and constructed with a two (2) hour fire resistant rating on the exterior portions of the structure.
Nothing in this subsection E is to be construed in order to abridge any zoning building setback requirements. (Ord. 2013-12)
