2-5-5: POSSESSION OR CONSUMPTION ON PUBLIC PROPERTY OR CONTROL PREMISES:
   A.   Prohibited: Unless specifically exempted, as set out below, no person shall possess any open container of or consume alcoholic liquor upon any public property, public street, alley, sidewalk, public way, or parking lot and other areas adjacent to licensed premises that a licensee controls or is responsible for within the corporate limits of the City of Carbondale.
   B.   Exceptions: Exceptions are made for the following events:
      1.   In the event of an approved City fair, alcoholic liquor may be consumed during said fair from non-glass containers, in a publicly owned or controlled space.
      2.   Events allowed in the City Hall/Civic Center, as otherwise provided in this title.
      3.   For events where such possession or consumption has been authorized pursuant to the approval of a temporary liquor license or permit.
      4.   For areas where a permit has been issued pursuant to subsection 17-1-5F (Sidewalk Restaurants) of this Code for license holders with permits for the permitted area.
      5.   Any area located within the downtown entertainment district beginning at five o'clock (5:00) P.M. until two o'clock (2:00) A.M. the next day Monday through Thursday and between the hours of twelve o'clock (12:00) P.M. (noon) until two o'clock (2:00) A.M. the following day, Friday through Sunday.
   C.   Removal From Premises: Except as permitted by the Illinois Liquor Control Act, and except for sealed containers such as growlers, crowlers, sealed containers, as defined by 235 Illinois Compiled Statutes 5/6-28.8, holding single servings of wine or premixed cocktails, or partially consumed bottles of wine which have been securely sealed by a restaurant and placed in a tamper evident bag, or for City-approved events specifically authorized to permit the open carry of alcohol in unsealed containers within specifically designated boundaries, no licensee shall allow or permit any individual to transport or carry any alcoholic liquor out of the premises of the licensee. The prohibition against removing alcohol from a premises does not apply in the downtown entertainment district during the established open container hours in subsection B of this section.
