A. Where this Chapter provides alternative penalties or remedies, they shall be cumulative and the imposition of one penalty or remedy shall not prevent the appropriate City officer from the invoking any other penalty or remedy provided for.
B. Unless otherwise provided, any person convicted of violating any provision of this Chapter or any rule or regulation promulgated hereunder, shall, upon conviction, be fined not more than seven hundred fifty dollars ($750.00) and costs for each offense. Each day of a continuing violation shall constitute a separate and distinct offense.
C. In addition to any penalty provided or imposed, any condition caused or permitted to exist in violation of any provision of this Chapter shall be deemed to be a public nuisance and may be abated by the City as provided in law or equity. Each day such condition continues shall constitute a separate and distinct offense.
D. Repeated violation of this Chapter or any franchise granted hereunder shall constitute cause for termination of the franchise. (Ord. 90-85; Ord. 97-166)
