19-1-8: CONSTRUCTION, INSTALLATION AND MAINTENANCE:
Within twelve (12) months of the date of execution of any agreement awarding a new franchise in accordance herewith for an unbuilt cable communications system, the operator shall offer to install, make operational, and render cable communications services to all residences within the City in accordance with this Chapter and any agreement awarding a franchise in accordance herewith, according to the following:
   A.   Operator shall construct, install, operate and maintain its system in a manner consistent with The Standards of Good Engineering Practices for Measurements on Cable Television Systems, published by the National Cable Television Association, 1983.
   B.   Operator shall, at all times, comply with the National Electrical Safety Code (National Bureau of Standards) and the National Electrical Code (National Bureau of Fire Underwriters).
   C.   Operator shall maintain all parts of the system in good condition throughout the entire franchise period.
   D.   All performances and technical standards governing construction, reconstruction, erection, installation, operation, testing, use, maintenance, and dismantling of the cable communication system shall be in accordance with all applicable FCC and other Federal, State and local laws and regulations.
   E.   All cables and wires shall be installed parallel with existing telephone and electric utility wires whenever possible.
   F.   Multiple configurations shall be in parallel arrangement and bundled, in accordance with engineering and safety consideration.
   G.   All installations shall be underground in those areas of the City where both telephone and electric utilities' facilities are underground at the time of the installation of the system.
   H.   Operator shall not open or otherwise disturb the surface or support of any street, sidewalk, driveway, public way, or other public place for any purpose whatsoever without obtaining authorization to do so from City. Operator shall repair any street it has disturbed at its own cost and expense, restore and replace any other property disturbed, damaged or in any way injured by or on account of its activities in a manner approved by the owner, to its condition immediately prior to the disturbance, damage or injury, or shall pay owner the fair market value thereof.
   I.   Where any damage is caused to any city property during construction or installation by operator, the cost of such repairs including all service and materials, required from city will be billed to operator and these charges shall be paid immediately. (Ord. 90-85)
