18-12-6: DESIGNATION OF LOADING ZONES:
   A.   Posting Signs: The city council hereby authorizes the city manager to determine the location of passenger and freight curb loading zones, and to place and maintain appropriate signs indicating the same, and stating the hours during which the provisions of this section are applicable. By the same authority, such loading zones may be changed or discontinued. Such loading zones may be established on the request of any person, provided that person meets the conditions set forth herein:
      1.   Commercial:
         a.   The property owned or leased by the applicant must be inaccessible except from the abutting street which must run in front of the property;
         b.   The property must be used for commercial or business purposes, as "commercial" and "business" are defined in the zoning ordinance of the city (title 15 of this code) or amendments thereto;
         c.   A business or commercial operation for which the property is used, must be of a nature which requires frequent loading and unloading at the location.
      2.   Noncommercial: That the property in question has a frequent need to load or unload people and such a designated area is necessary to provide a safe environment for this purpose.
   B.   Establishing, Maintaining Zones; Fees: Loading zones shall not be established until the applicant has paid to the city an amount equal to the cost of establishing and maintaining the loading zone on an annual basis. This amount shall be based upon the revenue which is received by the city from the space for which a loading zone is being requested. The amount of the revenue shall be calculated by the finance department and shall be paid to the city annually in advance on May 1 of each year. Failure to pay the amount of establishing and maintaining the zone shall be cause for revocation. Applications made after May 1 of each year shall be subject to a prorated annual fee with any part of a month being considered as one month, for the remainder of the year through April 30. The amount of establishing and maintaining the zone shall be computed annually, and that amount shall be provided to the applicant on April 1 of each year.
   C.   Zone Designation Revocation: The designation of a loading zone may be revoked upon occurrence of any of the following events:
      1.   Failure of the property to meet the standards set forth in this section;
      2.   Failure to pay the amount of establishing and maintaining the zone by May 1;
      3.   Violation of any of the other provisions of this section.
   D.   Use Of Zones; Time Limit:
      1.   No person shall stop, stand or park a vehicle for any purpose or length of time other than for the expeditious unloading and delivery or pick up and loading of materials in any place marked as a freight curb loading zone during hours which the provisions of this section are applicable. In no case shall the stop for loading and unloading materials exceed thirty (30) minutes.
      2.   The driver of a passenger vehicle may stop temporarily at a place marked as a loading zone for the purpose of and while actually engaged in loading or unloading passengers when such stopping does not interfere with any motor vehicle used for the transportation of materials which is waiting to enter or is about to enter such zone.
   E.   Numbering Of Zones: The zones as designated by the city manager shall be numbered consecutively, and shall be transferable from person to person, but not from location to location. (Ord. 2015-29)
