17-1-7: UNPROTECTED EXCAVATIONS PROHIBITED; REQUIREMENTS OF DESIGNATED STREETS:
   A.   Open Excavation Prohibited: No person making any excavation on or adjoining any street, alley or sidewalk shall leave said excavation open and unprotected.
   B.   Requirements Of Designated Streets:
      1.   Any person engaged in excavation or construction which requires the movement of dirt, rocks, sand or gravel in excess of ten thousand (10,000) pounds within the city, shall, prior to said transportation, acquire a designated route to points within the city from the director of public works. (Ord. 73-76 § 1; 1998 Code)
      2.   Any person so engaged as set forth in subsection B1 of this section may utilize any street within the city by filing a performance bond, which bond shall provide as follows: that the person shall utilize certain streets within the city as set forth therein; that he will assure that said streets shall be in the same condition as they were at the termination of said excavation or construction and the utilization of said streets, normal wear and tear excepted, as said streets were prior to said utilization; and shall provide a surety acceptable to the finance director of the city, which is acceptable to the director of public works.
