10-14-1: GENERAL PARKING REGULATIONS:
Off street vehicular parking in conjunction with all land or building uses shall be provided, prior to the issuance of a certificate of occupancy as herein prescribed. In all zoning districts, off street parking requirements for the storage and parking of self-propelled motor vehicles for the use of occupants, employees and patrons of the building hereafter erected, altered or extended after the effective date hereof, shall be provided as herein prescribed. Such space shall be maintained and shall not be encroached upon as long as said main building or structure remains, unless an equivalent number of such spaces are provided elsewhere in conformance with this chapter.
   (A)   When units or measurements determining number of required parking spaces result in requirements of a fractional space, such fractional space shall be reflected as one parking space.
   (B)   The off street loading space as required in this chapter shall not be construed as supplying off street parking space.
   (C)   Whenever a use requiring off street parking is increased in floor area and such use is located in a building existing on or before the effective date of this title, the minimum number of parking spaces required at the time of the increase in floor area shall be based on the usable floor area of the entire building including the addition.
   (D)   Off street parking for other than residential use shall be either on the same lot or within three hundred feet (300') of the building it is intended to serve, measured without crossing any major thoroughfare, from the nearest point of the building to the nearest point of the off street parking facilities and such off street parking shall be provided either by an off street parking lot or by a garage. In the case off street parking is provided in a garage, the maximum height of such garage shall be twenty feet (20') and may occupy the required side or rear space, but shall not be closer than twenty feet (20') from a lot line in a residential district.    (E)   Residential off street parking spaces shall consist of dust free parking strips, driveway, or combination thereof and shall be located on the premises they are intended to serve, not closer than three feet (3') from any street lot line. Garages and carports shall conform to the appropriate regulations of the zoning district in which they are located.
All required parking in R-3, R-4, B-1, B-2, B-3, and I districts and that required for churches and assembly places shall be paved as follows:
      1.   A one and one-half inch (11/2") bituminous concrete surface on a four inch (4") base of bituminous aggregate mix; or
      2.   A two inch (2") bituminous concrete surface on an eight inch (8") base of crushed gravel or crushed stone; or
      3.   A five inch (5") surface of portland cement concrete or structural equivalent of any of the foregoing as determined by the city engineer.
These specifications are minimum standards; parties anticipating use of parking lots by heavy vehicles or very high volumes of traffic should use a higher standard of pavement design. (Ord. 1937, 7-2-2008)
   (F)   For uses not specifically mentioned herein, the requirements for off street parking facilities for a use which is mentioned, and which use is most similar as interpreted by the city council after hearing and recommendation of the joint planning and zoning commission shall apply.    (G)   In case of mixed uses, the total requirements for off street loading space shall be the sum of the requirements of the various uses computed separately as specified in the preceding subsection, and the off street loading space for one use shall not be considered as providing the required off street loading space for any other use.
   (H)   Any area once designed as required off street parking shall not be changed to any other use unless and until equal facilities are provided elsewhere.
   (I)   Off street parking existing at the effective date of this title in connection with the operation of an existing building or use shall not be reduced to an amount less than hereinafter required for a similar new building or prior use.
   (J)   Two (2) or more buildings or uses may collectively provide the required off street parking in which case the required number of parking spaces shall not be less than the sum of the requirements for the several individual uses computed separately. Where the required number of parking spaces exceeds one hundred (100) cars, the requirements may be reduced by ten percent (10%).
   (K)   The required off street parking shall be for occupants, employees, visitors, and shall be limited in use to motor vehicles. The storage of merchandise, motor vehicles for sale, or the repair of vehicles is prohibited in required off street parking areas.
This requirement shall not be interpreted to prohibit the posting of a "for sale" sign in a personal vehicle which is used regularly by a resident of the structure for which the parking space is an accessory use. (Ord. 567, 11-1976)
   (L)   In cases of dual functioning of off street parking where operating hours do not overlap, the joint planning and zoning commission may grant a variation. Parking spaces already provided to meet off street parking requirements for theaters, stadiums, auditoriums, and other places of public assembly, stores, office buildings and industrial establishments located within five hundred feet (500') of a church, as measured along lines of public access, and that are not normally used between the hours of six o'clock (6:00) A.M. and six o'clock (6:00) P.M. on Sundays and are made available for other parking, may be used to meet not more than seventy five percent (75%) of the off street parking requirements of a church. There shall be a written agreement between all parties concerned where this arrangement is permitted. (Ord. 567, 11-1976; amd. Ord. 3041, 12-3-2013)
   (M)   Where lighting facilities are provided, they shall be so arranged as to reflect the light away from the adjacent residential districts or zones.
   (N)   The amount of required off street parking space for new uses or buildings, additions thereto, and additions to existing buildings as specified above shall be determined in accordance with the following table, and the space so required shall be stated in the application for a building permit and shall be irrevocably reserved for such use and/or shall comply with the initial part of this section.
   (O)   No certificate of occupancy will be issued upon completion of any building or repair operations unless and until all off street parking requirements, shown upon the plans, or made a part of the building permit, shall be in place and ready for use. (Ord. 567, 11-1976)
