In all contracts for street and alley improvement, where the city shall reserve the disposition of all surplus earth removed in excavations on such streets or alleys, no contractor or subcontractor shall in any manner sell or dispose of any such surplus earth, under a penalty of not less than fifty dollars ($50.00) for each offense.
