8-1-4: SUPERINTENDENT OF STREETS:
   (A)   Office Created, Appointment: There is hereby created the office of superintendent of streets of the city, who shall be appointed by the mayor, by and with the advice and consent of the council, on the first Tuesday in May of each year, or as soon thereafter as may be, and shall hold his office for the term of one year, and until his successor is duly appointed and qualified. (1959 Code § 36-5-1)
   (B)   Oath, Bond: Said superintendent shall, before entering upon the duties of his office, take and subscribe the oath prescribed by law for city officers, and shall execute a bond to the city in the penal sum of one thousand dollars ($1,000.00), with sureties to be approved by the city council, conditioned for the faithful performance of the duties of his office. (1959 Code § 36-4-2)
   (C)   Powers: The superintendent of streets shall have the power, subject to the provisions of this code and the orders of the mayor, to regulate and control the manner of using the streets, alleys, highways and public places of the city for the erection of telegraph poles, or other poles or posts; for the laying down of gas, water or steam pipes and conduits and such other underground construction authorized by law or the provisions of this code, as are not under the control of the city engineer, and to determine the location thereof and to cause the prompt repair of the streets, alleys, highways and public places, whenever the same are taken up or altered.    (D)   Duties: The said superintendent shall, subject to the provisions hereof, and the provisions of this code, take special charge and superintendence of all streets, alleys and highways in the city, and of all walks, crosswalks and public grounds and parks in the city; he shall have charge of the repair and cleaning of all streets, avenues and alleys of the city, and shall supervise the construction and repair of all sidewalks therein. He shall, without delay, cause all breaks in any street or alley crossing or other unsafe place to be repaired. (Ord. 865, 1-20-1981)
   (E)   Purchase Implements And Material; Mark Implements: He may procure the necessary implements for performing street labor or materials for bridges, culverts and crosswalks, but he shall purchase no implement of any material without making a written requisition to the mayor and obtaining his order therefor, and when he shall purchase any implements or materials for the use of the corporation, he shall report the bill therefor to the council. He shall cause all implements or tools belonging to the city to be legibly marked or branded with the letters "Canton", and shall cause them to be properly housed or protected from the weather when not in use.    (F)   Keep List Of Property, Turn Over To Successor: It shall be the duty of the superintendent of streets to keep a correct list of all implements, material and other property of the city in his charge and possession, and upon the expiration of his term of office, or his resignation or removal therefrom, he shall deliver said property to his successor in office, taking a receipt therefor, which he shall immediately file with the clerk, who shall credit him with the same and charge his successor therewith.    (G)   Books Of Account: It shall be the duty of said superintendent to cause to be kept in books of account, in such manner as may be required by the finance and personnel committee, a plain and accurate account of all expenditures made under his supervision, specifying to whom and for what purpose made. He shall examine all accounts of contractors and other persons for work pertaining to his department, or for implements or material furnished therefor, and if correct, shall certify the same to the council for allowance.    (H)   Monthly Report: Said superintendent of streets shall, on the first Tuesday in each and every month, report to the council in writing a statement of all expenditures under his supervision during the preceding month specifying the purpose of such expenditures, and, if required, the persons to whom paid. No account presented or certified by him shall be allowed, or warrants issued thereon, unless it shall be so rendered as to show to what account it is chargeable. (R.O. 1959, Ch. 36, Art. 4, Sec. 8)
   (I)   Enforcement, Orders: He shall cause all provisions in relation to streets, alleys and sidewalks to be enforced, by reporting all violations thereof to the mayor or chief of police. He shall carry into effect all such orders, general or special, as he may receive from the council, the mayor or committee on streets and alleys, and for any wilful neglect or refusal to perform any duty required of him by the laws or provisions of this code, he shall be liable to removal from office. He shall perform such other duties as shall be enjoined upon him by the provisions of this code or by law directed. (R.O. 1959, Ch. 36, Art. 4, Sec. 9)
   (J)   Employ Laborers, Keep Time: The street superintendent, upon appointment of the mayor and the advice and consent of the city council, may employ the following number of full time persons in the street and garbage departments:
      1.   Street department: Seven (7) full time laborers.
      2.   Garbage department: Three (3) full time laborers.
However, nothing herein shall be construed to preclude the street superintendent from hiring part time personnel on an "as needed" basis by appointment of the mayor and the advice and consent of the appropriate committee. He shall oversee and direct the laborers and workmen under his authority and require them to labor faithfully. He shall keep a written record of each such employee's time at work and shall, weekly, certify such record to the city clerk as his weekly payroll, stating therein the name of each employee, his weekly time, and the amount of his wages. The city clerk shall draw an order upon the city treasurer to each employee for such amount. (Ord. 977, 5-31-1983)
