6-3-5-2: PUBLIC INDECENCY:
   (A)   Specific Acts: Any person of the age of seventeen (17) years and upwards who performs any of the following acts in a public place commits a public indecency:
      1.   An act of sexual intercourse, or
      2.   An act of deviate sexual conduct, or
      3.   A lewd exposure of the body done with intent to arouse or satisfy the sexual desire of the person, or
      4.   A lewd fondling or caress of the body of another person of either sex.
   (B)   Public Place, Defined: "Public place" for purposes of this section means any place where the conduct may reasonably be expected to be viewed by others.
   (C)   Sentence: The offense of public indecency is a misdemeanor. A person who is convicted shall be punished by a fine of not less than one hundred dollars ($100.00) or more than five hundred dollars ($500.00). A second or subsequent offense is punishable by a fine of not less than three hundred dollars ($300.00) nor more than five hundred dollars ($500.00). (Ord. 908, 12-1-1981)
