6-2-1: FUND CREATED:
The council shall annually, hereafter, levy a tax upon all the taxable property in the city at the rate on the dollar of all such taxable property which will produce an amount which, when added to the deductions from the salaries or wages of policemen and receipts available from all other sources as hereinafter referred to, will equal a sufficient sum to meet the annual requirements of the pension fund under the provisions of this chapter. Such tax shall be levied and collected in like manner with general taxes of the city, and shall be in addition to all other taxes now or hereafter authorized to be levied upon all property within the city, and shall be in addition to the amount authorized to be levied for general purposes. In the event that the pension fund in any year over and above the reserve fund is sufficient to meet all demands of those requiring payment therefrom in such year, the council may dispense with the levy of such tax.
All monies derived from the taxes levied hereunder and the following monies shall be set apart by the treasurer of the city to constitute the police pension fund:
   (A)   Seven percent (7%) per month, which shall be paid or deducted from the salary of each member of the police department of the city.
   (B)   All monies that may have been accumulated by the city in conformity with any previous laws of the state of Illinois.
"Policeman", "policemen" or "member of the police force", as used in this chapter, shall mean any person heretofore or hereafter appointed to the police force of a police department, and sworn and commissioned to perform police duties. This chapter shall not apply to, nor shall any of the following persons be deemed eligible to participate in or benefit from a police pension fund established in a city, village or incorporated town, namely:
   (A)   Any person appointed to the police force of the police department before he has attained his twenty first birthday, or after he has attained his thirty sixth birthday at the time of his first appointment, except in those cities, villages or incorporated towns which first established a pension fund pursuant to the provisions of the statutes of Illinois, in which event all persons employed as policemen at the time such pension fund is first established shall be deemed eligible to participate in such pension fund, regardless of age at first appointment, and regardless of physical condition. This subsection shall not be construed to make ineligible a person who is, was or shall be reappointed to the police force of the police department after he has attained and passed his thirty sixth birthday, provided such person is otherwise qualified, and at the time of his first appointment to such police department was either a participant in, or eligible to participate in, any annuity or pension fund provided for by any existing annuity or pension statute in force at the time of his first appointment.
   (B)   Any person who shall be found upon the examination of a duly licensed physician or physicians selected by said board of trustees to be physically unfit or mentally unfit to perform the duties of a policeman.
   (C)   Any policeman who, within three (3) months after receiving his first appointment, and if reappointed, also within three (3) months after his reappointment, fails or refuses to make written application to the board of trustees hereinafter provided for to come under the provisions of this chapter.
   (D)   Part time policemen, special policemen, night watchmen, temporary employees, traffic guards or so called auxiliary policemen specially appointed to aid or direct traffic at or near schools or public functions, or to aid in civil defense, municipal parking lot attendants, clerks or other civilian employees of the police department who perform clerical duties exclusively; this chapter shall, however, apply to policemen serving initial probationary periods, and such policemen, if otherwise eligible, shall make contributions in the same manner as other policemen.
   (E)   Any policeman who fails or refuses to pay to the board of trustees the salary or wage payment or deductions hereinabove defined, computed from the date the city established a pension fund, or the date of a policeman's first appointment (including an appointment on probation), whichever is the later, and continuing during such policeman's entire service as a policeman. A policeman who is reappointed shall, before being declared eligible to participate in the pension fund, repay to the fund in the manner required by section 6-2-14 of this chapter any refund received pursuant to the provisions of said section 6-2-14 of this chapter.
