3-3-14-1: VIDEO GAMING MACHINES:
   (A)   Definition: "Video gaming machine" means any electronic video game machine that, upon insertion of cash, is available to play or simulate the play of a video game, including, but not limited to, video poker, in line, and blackjack, utilizing a video display and microprocessors in which the player may receive free games or credits that can be redeemed for cash. The term does not include a machine that directly dispenses coins, cash, or tokens or is for amusement purposes only. (Ord. 1773, 9-16-2003)
   (B)   License Required: Every person, firm or corporation, operating its place of business or carrying on its activities at a location within the territorial limits of the city of Canton, Illinois, shall first obtain a license for each video gaming machine operated or active at such location. The annual license fee for each such machine shall be the sum of twenty five dollars ($25.00) payable, by the owner of the gaming machines, annually in advance and no fee or portion thereof shall be refunded. The license shall be displayed on each machine at all times. (Ord. 2099, 10-3-2012)
   (C)   Application For License: Before any license shall be granted under the terms of this section, the person seeking said license shall file with the clerk, an application showing the location where the video gaming machine for which license is sought will be placed. The mayor shall then grant said license, attested by the clerk.
   (D)   Penalty: Any person convicted for a violation of any of the provisions of this section shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00). Each video gaming machine, which is not licensed, shall constitute a separate offense. (Ord. 1773, 9-16-2003)
