§ 96.28 PUBLIC SWIMMING.
   (A)   Council action and enforcement. The Council shall, by resolution, designate the date of the season opening and closing of the park swimming pool. The swimming pool shall be attended by lifeguards who shall work the hours and times designated by the Council. Duly appointed lifeguards are hereby authorized and empowered to order swimmers out of the pool waters at a time and under conditions as they deem necessary for public welfare.
   (B)   Unlawful acts. It is unlawful for any person to:
      (1)   Change clothes in any park except enclosures provided for the same;
      (2)   Carry on unnecessary conversation with lifeguards; or falsely call for help or assistance, or stand or sit upon or cling to any lifeguard perches or light towers;
      (3)   Conduct himself or herself in the water in a manner as to jeopardize the safety or health of himself or herself and others; and/or
      (4)   Having, or apparently having, any infectious disease to be permitted into the water.
