§ 52.99 PENALTIES.
   (A)   Any who is responsible for the or substantial threat of a of hazardous materials into the in violation of § 52.16 or who fails to report such or threatened in violation of § 52.17 of this chapter shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class A misdemeanor and subject to a fine of up to $500 or imprisonment of up to one or by both such fine and imprisonment as is otherwise provided by law for such offense. Each day the violation occurs, exists or continues shall be deemed to be a separate offense.
   (B)   Any who otherwise violates any provision of this chapter other than §§ 52.16 or 52.17 shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class B misdemeanor and subject to such fine of up to $250 or imprisonment up to 90 days in jail or by both fine and imprisonment as is otherwise provided by law for such offense. Each day the violation occurs, exists or continues shall be deemed to be a separate offense.
   (C)   In addition to the penalties provided in divisions (A) and (B) above, any violating any provisions of this chapter shall become liable civilly to the appropriate or city government for any expense, loss or damage to the government or agency thereof caused by reason of such violation, including, but not limited to, any clean-up, evacuation, administration or other expenses and legal expenses.
   (D)   The failure or refusal of anyone to pay all the incurred for under this chapter shall also constitute a criminal offense, and any who violates any of the provisions of this chapter by failing to pay said shall, upon conviction thereof by a court of competent jurisdiction, be guilty of a Class B misdemeanor and subject to a fine of up to $250 or imprisonment up to 90 days in jail or by both fine and imprisonment.
   (E)   The failure to file the forms required by § 52.15(F) by March 1 of each shall be subject to a fine of $5.00 for each day the forms are not filed after March 1 of each .
