§ 50.09 ELECTRIC EXTENSIONS AND INFRASTRUCTURE FEE.
   (A)   Extensions. Any person desiring to connect to the city's electric distribution system, or to construct any structure to be served by said electric distribution system, shall pay the electric system infrastructure fee (the "infrastructure fee"), as described in this chapter, prior to construction of the electric system improvements to serve said connection, whether such connection or the property served is inside or outside of the corporate limits of the city, in addition to any other applicable fees and charges described in this chapter. The infrastructure fee shall apply to the installation of new electric service to all residential and commercial premises (each unit requiring a new service), and is implemented to recover some or all of the infrastructure costs (as defined below) associated with electric service to the user's side of the point of delivery.
   (B)   Infrastructure costs. The infrastructure fee is structured to reimburse the city for all or a portion of the cost of labor and materials to install primary cable and wires, power quality equipment, switchgear and vaults, conduit, connections, protective equipment and other infrastructure and may include capital costs of administrative facilities that are reasonably related to the overall cost of and required in providing electric services to serve new or modified service connection (generally, the "infrastructure costs").
   (C)   Residential service. Each new residential electric customer (including developers) shall pay an infrastructure fee for each premises (each unit requiring a new service) to defray some or all of the infrastructure costs. All infrastructure costs in excess of the infrastructure fee shall be covered by the city.
   (D)   Commercial service. Each new commercial electric customer (including developers and any existing customer requiring an upgrade to their existing electric service infrastructure) shall pay an infrastructure fee for each premises (each unit requiring a new service) to defray some or all of the infrastructure costs.
      (1)   All infrastructure costs in excess of the infrastructure fee shall be covered by the city.
      (2)   Costs specific to extend new electric service to a commercial customer/developer are supplemental to infrastructure costs, are not covered by the infrastructure fee, and shall by paid by the customer. The city's Utility Department will provide an estimate of customer charges specific to a new service. The following are considered specific to extend service to a new commercial/developer service in accordance with the city's specifications: (i) switchgear and transformer pads, conduits from the point of attachment to the pad(s), transformer/switchgear vault rooms, and secondary conduit systems; (ii) secondary facilities, including conductor and lugs, spade extensions and transformer connections; and (iii) for additional services from an electric line, the entire service lateral installation, including all conduit, conduit riser, weather-head, and conductors.
   (E)   Infrastructure fee. The infrastructure fee shall be established by City Council in the annual budget or at such other times as may be approved by the City Council acting through ordinance. The infrastructure fee must be paid in full prior to any installation or construction. Respecting a multi-unit or subdivision development, all infrastructure fees shall be due and owing at the time that final engineering plans are submitted to the city. Due to equipment lead times and requirements, delays in payment may delay installation timelines and schedules.
   (F)   Repealer. To the extent the terms of this chapter, specifically including this § 50.09, conflict with any prior ordinance, resolution, regulatory, or other policy of the city, the provisions of this chapter shall be controlling in all cases.
