(A) Title 49 of the Code of Federal Regulations, (49 CFR) Subchapter C - Hazardous Materials Regulations, Part 171 - General Information, Regulations, and Definitions; Part 172 - Hazardous Materials Tables and Hazardous Material Communications Regulations; Part 173 - Shippers - General Requirements for Shipments and Packagings; Part 177 - Carriage by Public Highway, governing the transportation of hazardous materials in commerce on highways are hereby adopted by the city to ensure the application of those requirements to the city's streets.
(B) When any provision of this chapter is found to be in conflict with the regulations adopted in (A) above, the provision which establishes the higher standard for the promotion and protection of the safety and welfare of the public shall prevail.
