§ 96.04 BURNING OF INDUSTRIAL WASTE AND OTHER PRODUCTS.
   (A)   No person, firm, or corporation shall, within the city limits, throw any garbage, refuse, or industrial waste upon the ground or bury the same upon any premises, public or private, or burn the same in any place except in a heating plant or incinerator so designed as to thoroughly consume the same without causing a nuisance of smoke, flying ash, or offensive odors. Such heating plant or incinerator shall be approved by the Safety-Service Director.
   (B)   The Safety-Service Director shall have full and complete authority to make such rules and regulations as he deems necessary pertaining to the burning of garbage, refuse, and industrial wastes. Such rules and regulations, however, shall not be inconsistent with division (A) herein.
   (C)   The Safety-Service Director shall have full and complete authority to make such rules and regulations for the burning of paper products and leaves in the city as he deems necessary.

   (D)   Whoever violates this section or any rule, regulation, or order adopted pursuant to the provisions thereof and authorized thereunder, is guilty of a minor misdemeanor. Each separate violation shall be deemed a separate offense.
