§ 94.09 REGULATION OF DUMPSTERS.
   City Council hereby adopts the following regulations:
   (A)   Definition. For the purpose of this section, the term “dumpster” shall mean a container for the use of which is the disposal of garbage, rubbish, construction debris, junk or other waste material of any kind.
   (B)   No person shall place or cause to be placed any dumpster on public property or within a public right-of-way within the city without first filing an application and obtaining a permit from the City Engineer.
   (C)   Applications may be obtained from the office of the City Engineer and shall contain the following information:
      (1)   The name, address, and telephone number of any person placing the dumpster or requesting the placement of a dumpster.
      (2)   The estimated size and capacity of the dumpster.
      (3)   A general description of the nature and type of material to be collected in the dumpster.
      (4)   Estimated length of time and dumpster shall remain at the location.
      (5)   Proposed specific location for the dumpster.
   (D)   An application fee of $25 shall accompany the filing of the application in the office of the City Engineer.
   (E)   All dumpsters shall be located on private property whenever possible. The final location of all dumpsters on public property or within the public right-of-way shall be approved by the Service/Safety Director, or designee, prior to the placement of any dumpster.
   (F)   All dumpsters, enclosures, gates, and pads shall be maintained in good condition from cracks, rust, and peeling paint, and the like.
   (G)   All dumpsters shall be maintained free from overflowing litter and debris and shall be properly secured.
   (H)   All dumpsters shall have reflective material and/or barricades as directed by the Service/Safety Director or designee.
   (I)   Any violation of a condition of this section shall result in a fine in the sum of $50 per day. In addition to the financial penalty, any such violation shall be deemed a public nuisance, and may be abated by the city at the applicants’ expense.
