(A) A property owner shall obtain a permit from the Town Clerk/Treasurer prior to any excavation or earth-moving project on his or her property.
(B) The Clerk/Treasurer shall advise the applicant of the location of any water and sewer lines on his or her property at the time a permit is issued. In the event water or sewer lines are broken as a result of the excavation, the property owner shall be held liable for repairs or replacements to the water or sewer system.
(C) Any other person who is permitted to use the rights-of-way upon which water and sewer lines are situated shall be liable for any and all expenses incurred for repairs or replacement of any water and sewer lines which may be damaged or destroyed as a result of his or her use of the right-of-way for any purpose.
