1317.03 PRIOR USES NOT CONFORMING TO THE REGULATIONS.
   After the effective date of this chapter, any use of a principal residential structure not in compliance with all of the regulations of Section 1317.02 , hereinafter “the Regulations” shall be considered nonconforming, except as hereinafter provided.
   (a)   A prior nonconforming use existing as of the effective date of this chapter may be continued, except that if it is voluntarily discontinued for one (1) or more years, the use shall then be deemed abandoned, and any further use shall be in compliance with the uses prescribed by the Regulations of this chapter.
   (b)   Any structure existing as a nonconforming use at the time of the effective date of this chapter which is destroyed by wind, fire or other unavoidable casualty, and whose total square footage destroyed is less than fifty percent (50%) of the total square footage of the structure may be reconstructed and restored, providing that the same is done within six months from the date of said destruction.
   (c)   A nonconforming structure existing at the time of the effective date of this chapter which is destroyed by wind, fire or other unavoidable casualty may not be reconstructed and restored except in compliance with this chapter if the destruction affects more than fifty percent (50%) of the square footage of the structure.
   (d)   A nonconforming structure may not be altered or enlarged so as to extend said nonconforming use by more than twenty-five percent (25%) of the original area of the nonconforming building or structure existing prior to the extension or enlargement.
   (e)   A nonconforming use changed so as to comply with any of the Regulations shall not thereafter be changed so as to be in violation of the Regulations.

   (f)   The regulations of this section and other provisions of this chapter shall not be applicable to areas defined as Manufactured Home Parks under Ohio R.C. Chapter 3733. (Ord. 95-11. Passed 4-6-95.)
   (g)   For any other construction, reconstruction, enlargement, location, erection, placement or other change in any nonconforming use, the owner of the lot and manufactured home shall make application to the Building Inspector for a construction certificate, as hereinafter set froth.
