351.16  EVENING TRUCK PARKING; MAXIMUM CONSECUTIVE HOURS LIMITED.
   (a)   No person shall stop, stand or park a truck, trailer, tractor, tractor/trailer, or unattached trailer on any street, alley, right of way, or parking lot within the Village, or upon any property in the Village not zoned industrial (I), between the hours of 5:00 p.m. and 7:00 a.m., for any other purpose than loading or unloading pursuant to Section 351.09, provided, however, that trucks of one-ton capacity or under are exempt from the provisions of this section.
   (b)   No person shall park a truck, trailer, tractor, tractor/trailer, or unattached trailer on any street, alley, right of way or parking lot in the Village for any period of time longer than two hours.
   (c)   The provisions of this section may be temporarily suspended, upon written order of the Chief of Police or his designee, in cases of a real and present emergency.
   (d)   Any vehicle in violation of this section may be towed at the owner’s expense upon order of the Police Department.  The owner of the vehicle shall be assessed the removal and storage charges as provided in Section 303.083(c).
   (e)   Whoever violates any provision of this section shall be guilty of a minor misdemeanor upon the first offense, and shall be guilty of a misdemeanor of the fourth degree upon any subsequent offense.  Each successive day on which a violation continues shall constitute a separate offense.  (Ord. 97-11.  Passed 9-10-97.)
