§ 94.01 OUTDOOR BURNING.
   (A)   It shall be unlawful to burn or set fire to any non-vegetative materials, such as household garbage, lumber, or any synthetic materials.
   (B)   The open burning of leaves, logs, stumps, tree branches, or yard trimmings is allowed as permitted by applicable state law without an air quality permit if the following conditions are met:
      (1)   The material burned originates on the premises of the private residence upon which it is burned;
      (2)   The burning is initiated no earlier than 8:00 a.m. and no additional combustible material is added to the fire between 6:00 p.m. on one day and 8:00 a.m. on the following day;
      (3)   The burning does not create a nuisance; and
      (4)   Material is not burned when the North Carolina Forest Service has banned burning for that area.
   (C)   Open burning is also permissible without an air quality permit if allowed under and carried out in accordance with 15A NCAC 02D.1903(b)(2) through (b)(12).
   (D)   No person shall kindle or maintain any outdoor fire or authorize any fire to be kindled or maintained on any land unless the location of such fire is at least 50 feet from any dwelling, structure, or residence other than a dwelling, structure, or residence owned or occupied by the person doing such burning and adequate provisions are made to prevent fire from spreading to within 50 feet of any dwelling, structure, or residence not owned or occupied by the person doing such burning.
