(A) Zoning compliance permit. Development, including the erection of structures and placement of mobile homes, within a flood hazard area shall not occur except upon issuance of a zoning compliance permit in accord with the requirements of Chapter 157 of this code and the following standards:
(1) The requirements of this section shall be met;
(2) The requirements of the underlying zoning districts and applicable general provisions of this ordinance shall be met; and
(3) All necessary development permits shall have been issued by appropriate local, state, and federal authorities, including a floodplain permit, approval, or letter of no authority from the State Department of Natural Resources under authority of Public Act 245 of 1929, being M.C.L.A. §§ 323.1 - 323.12, as amended by Public Act 167 of 1968, being M.C.L.A. §§ 323.1 - 323.5b. Where a development permit cannot be issued prior to the issuance of a zoning compliance permit, a letter from the issuing agency indicating intent to issue contingent only upon proof of zoning compliance shall be acceptable.
(B) Enclosures below a structure’s lowest floor. For all new construction and substantial improvements, fully enclosed areas below the lowest floor that are subject to flooding shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of flood waters. Designs for meeting this requirement must either be certified by registered professional engineer or architect or must meet or exceed the following minimum criteria:
(1) A minimum of 2 openings having a total net area of not less than 1 square inch for every square foot of enclosed area subject to flooding shall be provided;
(2) The bottom of all openings shall be no higher than 1 foot above grade; and
(3) Openings may be equipped with screens, louvers, or other coverings or devices, provided that they permit the automatic entry and exit of flood waters.
(C) Mechanical and electrical equipment. All the electrical, heating, ventilation, plumbing, and air-conditioning equipment and other service facilities shall be designed and located so as to prevent water from entering or accumulating within the components during conditions of flooding.
(D) New subdivision proposals and development. All new subdivision proposals and other proposed developments (including proposals for manufactured home parks and subdivisions) greater than 50 lots or 5 acres, whichever is the lesser, include within those proposals base flood elevation data.
