§ 155.05   USES IN FLOODPLAIN AREAS.
   (A)   The following uses shall be permitted in floodplain areas, provided that no such use shall interfere with the natural drainage of floodplain areas, and provided also that these uses shall not unreasonably interfere with the natural storage capacity of storm waters upon the floodplain areas.  Uses not allowed herein are prohibited.
      (1)   Uses permitted upon floodplain areas shall include the following:
         (a)   Agricultural uses such as general farming, pasture, grazing, outdoor plant nurseries, horticulture, viticulture, truck farming, forestry, sod farming, and wild crop harvesting;
         (b)   Industrial-commercial uses such as loading areas, parking areas, airport landing strips;
         (c)   Private and public recreational uses such as golf courses, tennis courts, driving ranges, archery ranges, picnic grounds, boat launching ramps, swimming areas, parks, wildlife and nature preserves, game farms, fish hatcheries, shooting preserves, target ranges, trap and skeet ranges, hunting and fishing areas, and hiking and horseback riding trails; and
         (d)   Residential uses such as lawns, gardens, parking areas, and play areas.
      (2)   Mechanical and utility equipment used in conjunction with the above stated uses shall be subject to the following:  all electrical, heating, ventilation, plumbing, and air-conditioning equipment and other service facilities shall be designed and located so as to prevent water from entering or accumulating within the components during conditions of flooding.
   (B)   (1)   The following uses which involve structures (temporary or permanent), fill, or storage of equipment may be permitted in floodway or floodplain areas after application to the Board of Flood Control Appeals and approval of that Board if the Board shall determine that the structures will not unreasonably interfere with the natural drainage of the floodway or floodplain area, and provided further that the Board shall determine that occasional flooding will not in all likelihood damage the structure or use:
         (a)   Circuses, carnivals, and similar transient amusement enterprises;
         (b)   Drive-in theaters, new and used car lots, roadside stands, signs, and billboards;
         (c)   Extraction of sand, gravel, and other materials;
         (d)   Marinas, boat rentals, docks, piers, and wharves;
         (e)   Railroads, streets, bridges, utility transmission lines, and pipelines;
         (f)   Storage yards for equipment, machinery, or materials;
         (g)   Kennels and stables; and
         (h)   Other uses and structures similar to the above which are not likely to be damaged by a flood and which do not unreasonably interfere with natural drainage of storm water.
      (2)   Mechanical and utility equipment used in conjunction with the above stated uses shall be subject to the following:  all electrical, heating, ventilation, plumbing, and air-conditioning equipment and other service facilities shall be designed and located so as to prevent water from entering or accumulating within the components during conditions of flooding.
