(B) In the case of commercial advertising signs found to violate § 153.06(E), § 153.07(A)(9), and § 153.07(A)(10), rather than immediately confiscating, removing and destroying a non-conforming sign, the city may, at its option, elect to notify the individual, corporation or other entity advertising its goods or services by first class mail at any address displayed on the sign that the sign is in violation of this ordinance and that in the event the sign is not removed within 5 business days of the date of the mailing of the notice, the individual, corporation or other entity shall be charged with a municipal civil infraction and shall be subject to such fines and costs as set forth in the City of Burton Code of Ordinances, § 131.05, Civil Infraction Penalties.
(C) In the event a sign found to be in violation of § 153.06(A), § 153.06(E), § 153.07(A)(9), or § 153.07(A)(10) shall not set forth the address or any business or individual, but shall display a telephone number, the city may elect to place a telephone call to the number displayed and notify any individual who answers such a telephone call, or leave a recording on any recording device, that the sign must be removed within 5 business days of the telephone notification, and that the failure to remove the sign within that time shall result in the issuance of a civil infraction citation.
(D) In the event of a violation of any other section of this ordinance, the city shall notify the individual, corporation or other entity owning the property at which the sign is placed by first class mail, at the address on record with the Assessors office, that the sign is in violation of this ordinance and that in the event the sign is not removed, repaired, or brought into compliance of this ordinance within 10 business days of the date of the mailing of the notice, the individual, corporation or other entity shall be charged with a municipal civil infraction and shall be subject to such fines and costs as set forth in the
City of Burton Code of Ordinances, § 131.05, Civil Infraction Penalties and/or subject to immediate confiscation, removal and destruction by the City of Burton, in which all costs will be charged to the property owner.
