§ 115.01   DRIVE-IN RESTAURANTS.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      DRIVE-IN RESTAURANT.  Any establishment where food or beverage is sold to consumers and where motor vehicle parking space is provided and where that food or beverage is intended to be consumed in the motor vehicle parked on the premises or anywhere on the premises outside of the building.
      OPERATOR.  Any person, as defined herein, who shall have charge of the operation of the drive-in restaurant.
      WASTE MATERIAL.  Paper cups, straws, napkins, garbage, beverages, and all other waste matter intended for disposal, which, if not placed in a proper receptacle, tends to create a public nuisance by rendering property unclean, unsafe, and unsightly.
   (B)   The operator shall maintain quiet and good order upon the premises of a drive-in restaurant and shall not permit disorderly or immoral conduct or loitering.  The operator shall not cause or create any noise or other nuisance on the parking area of a drive-in restaurant whereby the quiet and good order of the premises or of the neighborhood is disturbed.
   (C)   The operator shall at least once in 24 hours dispose of waste materials which tend to create a public nuisance on the premises.  The operator shall keep the premises whereon the drive-in restaurant is located, together with the parking area and that portion of any street or alley adjoining the drive-in restaurant, free from waste material.  The operator shall provide the drive-in restaurant with sufficient number of adequate refuse containers, and shall erect fences, barriers, or otherwise so as to prevent the accumulation of waste materials originating from the drive-in restaurant from blowing onto adjoining property or streets.
   (D)   The parking area of any drive-in restaurant shall be adequately illuminated by electric lights, but the illumination shall be so arranged by the operator as to reflect away from any adjoining residential property.
   (E)   The parking area on the premises of a drive-in restaurant shall be satisfactorily paved or treated by the operator so as to avoid creating dust and so as to provide for adequate drainage of surface water.
